Truck Accidents on I-85, Spaghetti Junction and Jimmy Carter Boulevard

Atlanta Truck Accident Attorneys image

The stretch of I-85 through Norcross ties metro Atlanta’s freight terminals and distribution centers to the rest of the Southeast. Tractor-trailers, box trucks and delivery vans merge on and off at Jimmy Carter Boulevard, Indian Trail and Beaver Ruin Road. Then they funnel into the Tom Moreland Interchange, better known as Spaghetti Junction, where I-85 meets I-285 in northern DeKalb County next to Doraville.

Local planners have flagged the risk. The Gateway85 Community Improvement District reports that the Jimmy Carter Boulevard and Buford Highway corridor carries more than 57,000 drivers a day, with above-average crash and injury rates. The district has also planned lane and turn-lane improvements at the Jimmy Carter Boulevard and Buford Highway intersection.

Who Can Be Responsible for a Norcross Truck Crash

The driver and the motor carrier are usually the main defendants. Georgia also allows claims against the carrier for its own negligent hiring, training and supervision, even when it admits the driver was working for it. The Georgia Supreme Court so held in Quynn v. Hulsey (2020). Depending on the facts, the truck owner, a maintenance shop, the shipper that loaded the cargo or a freight broker may share fault.

Truck Evidence Disappears Fast

Federal rules require carriers to keep hours-of-service records for only six months and maintenance records for one year. No federal rule requires them to keep engine control module data, the truck’s “black box.” We send a preservation letter right away. Under Georgia law, a company that knows or should know a claim is coming has a duty to preserve the evidence. Read what evidence a trucking company has to keep after a crash.

How Much Insurance a Trucking Company Carries

Interstate for-hire carriers hauling general freight must carry at least $750,000 in liability coverage, and more for oil and hazardous loads. Many carry excess or umbrella policies on top of that. For crashes on or after July 1, 2024, Georgia lets you add the trucking company’s insurer to a lawsuit only in limited situations, such as a carrier in bankruptcy or a driver who can’t be served. Rideshare drivers pick up and drop off all day along Buford Highway, Peachtree Industrial Boulevard and the shopping centers off Jimmy Carter Boulevard. When one causes a crash, the coverage that applies depends on what the driver’s app was doing at that moment.

Which Rideshare Policy Pays Depends on the App

Georgia law (O.C.G.A. 33-1-24) sets the minimums. With the app on and no ride accepted, the rideshare policy must provide at least $50,000 per person and $100,000 per accident for injuries. From the moment a ride is accepted until it ends, the minimum is $1 million in liability coverage. For crashes since July 1, 2023, the required uninsured and underinsured motorist coverage during a ride is $300,000 per accident and $100,000 per person. Read how app status changes Uber and Lyft insurance in Georgia.

Passengers, Other Drivers and Pedestrians

If your rideshare driver caused the crash, the rideshare liability policy is the main source of payment. If another driver caused it during a ride and doesn’t carry enough insurance, the rideshare uninsured motorist coverage may help. Drivers, cyclists and pedestrians hit by a rideshare car can claim against the driver’s coverage and, while the app is on, the rideshare coverage, which is higher once a ride is accepted. Get Medical Care First

Grady Memorial Hospital in Atlanta is a Level I trauma center, and Northside Hospital Gwinnett in Lawrenceville is a Level II trauma center, according to the Georgia Department of Public Health. Keep every record and bill. Follow up with a doctor even if the pain seems minor at first.

Get the Crash Report

The Gwinnett County Police Department handles crashes in unincorporated Gwinnett County and Peachtree Corners, and its West Precinct is in Norcross. The department says reports are available through BuyCrash, or in person for $5, about four business days after the report is taken. Inside city limits, such as Norcross, Duluth and Lawrenceville, the city’s own police handle the crash. Norcross Police release reports through BuyCrash or the city’s online records portal in three to five business days. The Georgia State Patrol may handle interstate crashes, and the Doraville Police Department handles crashes in Doraville.

Be Careful With the Insurance Company

The trucking or rideshare insurer may call within days and ask for a recorded statement. You don’t have to give one to the other side’s insurer. Don’t sign a release or cash a check before you know the full extent of your injuries.

Gwinnett and DeKalb County Courts

Norcross, Peachtree Corners, Duluth and Lawrenceville are in Gwinnett County, whose State and Superior Courts sit at the Gwinnett Justice and Administration Center in Lawrenceville. Doraville and Chamblee are in DeKalb County, where the courthouse in Decatur hears civil cases. Georgia law generally lets you sue a motor carrier in the county where the crash happened (O.C.G.A. 40-1-117). Jonathan Flack files suit and takes cases to court when insurers won’t pay fair value.

Georgia Filing Deadlines

In most injury cases you have two years from the crash to file suit (O.C.G.A. 9-3-33), and four years for vehicle damage. Claims involving a city, county or state vehicle have shorter notice deadlines. Truck evidence can be gone long before any of these deadlines, so call early.
