I-285 and I-85 Truck Accident Lawyer in Atlanta

Jonathan Flack is an I-285 truck accident lawyer for people hurt by tractor-trailers on the Perimeter, I-85, Spaghetti Junction and the Downtown Connector. Georgia law keeps most through trucks off the interstates inside the Perimeter, which routes them onto I-285 itself. If a truck hit you there, the evidence and insurance rules differ from a normal car crash.

Flack Injury Law represents injured people only, and we focus on motor vehicle crashes that someone else caused. Attorney Jonathan Flack keeps a limited caseload so he can work directly on every case from our Midtown Atlanta office, about a half-hour drive down I-85 from Norcross. He speaks Spanish and meets Spanish-speaking clients without an interpreter.

Why Trucks Use I-285 Instead of Driving Through Atlanta

Atlanta Truck Accident Attorneys image

Georgia law bars most large trucks from I-20, I-75, I-85 and GA 400 inside the arc of I-285 (O.C.G.A. § 40-6-51(a)(1)). The rule covers any motor vehicle with more than six wheels and commercial motor vehicles. The Georgia Department of Public Safety says trucks on I-75, I-85 or I-20 must use I-285 to go around the city.

There are exceptions. A truck may drive inside the Perimeter for a local pickup or delivery, or to reach its terminal, a repair shop or the driver’s home.

The Downtown Connector

The Downtown Connector is the shared stretch of I-75 and I-85 through the middle of Atlanta, so the same restriction applies. A tractor-trailer on the Connector should have a local reason to be there. If the truck that hit you did not, that fact belongs in the investigation.

Lane Rules for Trucks on the Perimeter

Georgia also limits which lanes trucks may use (O.C.G.A. § 40-6-52). On a road with three or more lanes in one direction, a truck with more than six wheels (other than a bus or motorcoach) must stay in the two right-hand lanes unless it is preparing for a left turn. On interstates with four or more lanes in one direction, GDOT may post signs designating truck lanes, and trucks must follow them. If a truck was in a lane it should not have been in, photograph the lane markings.

Where Truck Crashes Happen on I-285 and I-85

Truck crashes tend to happen where highways merge, split and shift through construction.

Spaghetti Junction

Spaghetti Junction is the I-85 and I-285 interchange in DeKalb County. The State Transportation Board formally named it the Tom Moreland Interchange in 1987. I-85 continues northeast from here into Gwinnett County, and our Norcross truck accident attorney page covers the Gwinnett side.

The I-20 and I-75 Interchanges

The Georgia Department of Transportation (GDOT) began rebuilding the I-285 and I-20 West interchange in Fulton and Cobb counties in July 2025. Its fact sheet says the project removes left-hand ramps and adds lanes, with completion expected in 2030. On the northwest side, the I-285 and I-75 interchange in Cobb County joins two of the region’s main truck routes.

Work Zones and the New Toll Lane Project

GDOT’s work zone fact sheet, citing federal crash data, says Georgia recorded 377 fatal work zone crashes involving large trucks over 10 years. That was the fourth highest of any state. More construction is coming. In October 2026, the State Transportation Board approved GDOT’s choice of a private team to build and run new toll lanes on the north side of I-285, the Atlanta Journal-Constitution reported. The first phase is not expected to open until 2034.

Who Investigates a Truck Crash on I-285, and How to Get the Report

The agency depends on location. The Georgia State Patrol, the Atlanta Police Department or a county or city police department may work a crash on the Perimeter. Ask the officer for the agency name and report number before you leave.

For a State Patrol report, Georgia DPS says to contact the local State Patrol post or its Open Records Unit at (404) 624-7591. Atlanta Police reports can be bought online through BuyCrash or picked up at Central Records, 3493 Donald Lee Hollowell Pkwy NW. Cobb County Police says its reports are generally ready two to three business days after the crash.

Federal Trucking Rules That Shape Your Claim

Federal trucking rules often decide what evidence exists and how much insurance is available.

Hours of Service and Testing

A truck driver may drive up to 11 hours within a 14-hour window after 10 hours off duty, and needs a 30-minute break after 8 hours of driving (49 CFR 395.3). Drug and alcohol testing is required after a fatal crash, and after some injury or tow-away crashes where the driver is cited (49 CFR 382.303).

Records That Can Disappear

Carriers only have to keep hours-of-service records for six months (49 CFR 395.8(k)) and driver vehicle inspection reports for three months (49 CFR 396.11). No federal rule requires keeping engine control module data. A preservation letter matters, because a company’s duty to preserve evidence begins when it knows, or reasonably should know, that litigation is being contemplated (Phillips v. Harmon, 297 Ga. 386 (2015)).

Insurance and Who Is Responsible

Interstate for-hire carriers hauling general freight must carry at least $750,000 in liability coverage, and more for oil and certain hazardous materials (49 CFR 387.9). Our guide to Georgia truck insurance coverage limits explains excess policies. For claims arising on or after July 1, 2024, you can sue the carrier’s insurer directly only in limited cases, such as when the carrier is bankrupt or cannot be served (O.C.G.A. §§ 40-1-112(c), 40-2-140(d)(4)). The trucking company can also face negligent hiring or entrustment claims even if it admits the driver was on the job (Quynn v. Hulsey, 310 Ga. 473 (2020)).

What to Do After a Truck Hits You on I-285 or I-85

Call 911, get medical care, and document the truck before it leaves. Georgia’s Department of Public Health lists Grady Memorial Hospital in Atlanta as a Level I trauma center. If you can do so safely, photograph the cab door, the company name, any USDOT number, the trailer and the lane the truck was in.

Get witness names and phone numbers. Do not give the trucking insurer a recorded statement before you get advice. If the trailer swung across lanes, our article on jackknife truck accident fault in Georgia explains how fault is sorted out. Our step-by-step guide for people hit by a semi truck in Georgia covers the first days after the crash.

Deadlines, Fault and How Jonathan Flack Helps

You generally have two years from the crash to file a personal injury lawsuit in Georgia (O.C.G.A. § 9-3-33), and four years for property damage (O.C.G.A. § 9-3-31). Georgia reduces your damages by your share of fault and bars recovery at 50% or more (O.C.G.A. § 51-12-33).

Jonathan spent two and a half years on the insurance side of commercial truck, tractor-trailer and medical transport van cases before founding the firm. Now he represents only injured people, keeps a limited caseload and works directly on every case. The firm recovered $650,000 for a client hurt in a head-on collision with a tractor-trailer in Peachtree City. Prior results do not guarantee a similar outcome.

I-285 and I-85 Truck Accident FAQ

Why Downtown Connector Traffic On I-75 and I-85 Increases Semi-Truck Collision Risks img
Are tractor-trailers allowed on the Downtown Connector?

Most are not, unless they have a local reason to be there. Georgia law bars vehicles with more than six wheels and commercial motor vehicles from I-75 and I-85 inside the arc of I-285, with exceptions such as local pickups and deliveries (O.C.G.A. § 40-6-51). Through trucks must use I-285.

Can a truck drive in the left lane of I-285?

Generally, no. On highways with three or more lanes in one direction, Georgia requires trucks with more than six wheels to stay in the two right-hand lanes unless preparing for a left turn (O.C.G.A. § 40-6-52). On interstates with four or more lanes in one direction, GDOT’s posted truck-lane signs control (O.C.G.A. § 40-6-52(d)).

Who investigates a truck crash on the Perimeter?

It depends on location. The Georgia State Patrol, the Atlanta Police Department or a county or city police department may respond. Ask the officer for the report number at the scene.
