After a fatal truck accident in Georgia, the surviving spouse, children or parents can bring a wrongful death claim for the full value of that person’s life. The person’s estate can bring a separate claim for medical and funeral expenses and for any pain they suffered before death. Most of these claims must be filed within two years of the death, and the estate’s claim for pain and suffering can run from the date of the crash. Truck cases also turn on evidence the trucking company controls, so families should act well before that deadline.
Who Can File a Wrongful Death Claim in Georgia
Georgia law sets the order. Only one person or group holds the claim at a time:
- The surviving spouse. The spouse brings the claim and shares any recovery equally with the children, but never receives less than one-third (O.C.G.A. § 51-4-2).
- The children. If there is no surviving spouse, the children bring the claim together, whether they are minors or adults.
- The parents. If the person who died left no spouse or child, the parents hold the claim (O.C.G.A. § 51-4-4).
- The estate’s administrator or executor. If none of those relatives survive, the personal representative brings the claim and holds the money for the next of kin (O.C.G.A. § 51-4-5).
A surviving spouse can settle the claim without a court order. If there is no surviving spouse and a minor child’s share of a settlement is over $25,000, a court must approve it (O.C.G.A. § 29-3-3).
What a Wrongful Death Claim Pays For
Georgia measures the claim by the “full value of the life of the decedent,” without subtracting what the person would have spent on themselves had they lived. In Bibbs v. Toyota Motor Corp. (2018), the Georgia Supreme Court explained that the value is measured from the point of view of the person who died. It has two parts:
- Economic value: the income, benefits and household services the person would have provided over their lifetime.
- Intangible value: the value of living itself, including time with family, work, hobbies and everyday life.
The family’s own grief is not a separate item of damages, though the jury hears about the life that was lost. Money recovered on a wrongful death claim is not subject to the debts of the person who died.
The Estate’s Separate Claim
Alongside the family’s claim, the estate’s personal representative can recover medical, funeral and other necessary expenses caused by the crash (O.C.G.A. § 51-4-5(b)). If the person was conscious for any time before death, the estate can also recover for that pain and suffering. This claim belongs to the estate, so someone usually has to be appointed by the probate court to bring it.
Deadlines for a Georgia Wrongful Death Claim
- Two years from the death is the general deadline (O.C.G.A. § 9-3-33).
- The estate’s claim can be paused for up to five years while no one has been appointed to represent the estate (O.C.G.A. § 9-3-92). That pause does not extend the family’s wrongful death claim.
- A criminal case against the driver does not pause the family’s claim. Georgia’s Court of Appeals held in 2022 that surviving relatives are not the “victims” who get extra time under the crime-victim tolling statute.
- Government vehicles such as city or county trucks have shorter written notice deadlines.
Why a Truck Accident Wrongful Death Case Is Different
More Than One Company May Be Responsible
Besides the driver, the motor carrier can be liable for the driver’s conduct and for its own negligent hiring, training or supervision. The Georgia Supreme Court held in Quynn v. Hulsey (2020) that those claims can go to the jury even when the company admits the driver was working for it. The truck owner, a maintenance shop, the shipper that loaded the cargo or a freight broker may also share fault. See who is at fault in a jackknife truck accident for how fault gets sorted out.
Trucking Companies Carry More Insurance
Interstate for-hire carriers hauling general freight must carry at least $750,000 in liability coverage, $1 million for oil and certain hazardous materials, and $5 million for some hazardous loads (49 CFR § 387.9). Many also carry excess or umbrella policies. For crashes on or after July 1, 2024, Georgia only lets families add the trucking company’s insurer to a lawsuit in limited situations, such as a carrier in bankruptcy or a driver who can’t be served.
The Driver Must Be Drug and Alcohol Tested
After any crash that kills someone, federal rules require the trucking company to test its driver for alcohol and drugs (49 CFR § 382.303). The alcohol test should happen within two hours and can’t be attempted after eight. The drug test can’t be attempted after 32 hours. Those results, or a missing test, can matter a great deal.
Key Evidence Has a Short Shelf Life
- Hours-of-service records and supporting documents: kept for six months.
- Maintenance records: kept for one year. Driver vehicle inspection reports: kept for three months.
- The company’s accident register: kept for three years.
- The driver’s qualification file: kept for the length of employment plus three years.
- Engine control module (“black box”) data: no federal rule requires the company to keep it.
A preservation letter puts the company on notice. Under Georgia law, a company that knows or reasonably should know a claim is coming has a duty to preserve the evidence. Read more about what evidence a trucking company has to keep after a crash.
How Fault Affects a Wrongful Death Claim
Georgia’s comparative fault rule applies. If the person who died was partly at fault, the recovery is reduced by that share, and there is no recovery if they were 50 percent or more at fault (O.C.G.A. § 51-12-33). Trucking companies often argue the other driver caused the crash, so reconstruction and black box data matter. In lawsuits filed on or after April 21, 2025, a jury can also hear whether the person who died wore a seat belt.
Criminal Charges and the Civil Claim
A driver who kills someone while impaired, driving recklessly or fleeing police can be charged with first-degree homicide by vehicle, a felony (O.C.G.A. § 40-6-393). The criminal case is separate from the family’s civil claim, and a family doesn’t need a conviction to recover. Families may also apply to the Georgia Crime Victims Compensation Program, which can pay up to $25,000 in total, including up to $6,000 for funeral costs, if the crime was reported to police within 72 hours and the application is filed within three years.
Georgia Truck Crash Deaths by the Numbers
According to NHTSA, 197 people died in Georgia crashes involving large trucks in 2024, based on preliminary data (NHTSA Traffic Safety Facts: Large Trucks, 2024 data).
What Families Can Do Now
- Get the crash report and the death certificate.
- Write down the trucking company’s name and the USDOT number if you have it.
- Don’t give a recorded statement to the trucking company’s insurer.
- Keep every funeral, medical and travel receipt.
- Talk to a truck accident lawyer quickly, so a preservation letter goes out before records are lost.
Frequently Asked Questions
The surviving spouse comes first and shares the recovery with any children. If there is no spouse, the children bring the claim. If there is no spouse or child, the parents do. If none survive, the estate’s personal representative brings it for the next of kin.
Generally two years from the date of death. A criminal case against the truck driver does not pause the family’s claim. Some trucking records are only kept for six months, so call well before the deadline.
There is no average. Georgia measures the claim by the full value of the life of the person who died, including lifetime earnings and the value of living itself. The estate can also recover medical and funeral costs. Interstate trucking companies hauling general freight must carry at least $750,000 in coverage, and often more.
It can help, but the cases are separate. A family does not need a criminal conviction to win a civil wrongful death claim, and the civil deadline keeps running while the criminal case is pending.
Often yes, for the estate’s separate claim for medical and funeral expenses and the person’s pain and suffering. The probate court appoints the personal representative. The family’s wrongful death claim itself is brought by the spouse, children or parents.
